Membership Agreement
1. Definitions
“We,” “Us,” and “Our” refer to Falcon Holding II o/b/o Belvedere Cigar Lounge.
“Premises” refers to 239 N. White Horse Pike, Lawnside, NJ 08045.
“Member” refers to individuals who have signed this Membership Agreement and whose membership is active and in good standing.
2. Access to Private Lockers
We reserve the right to access private lockers without prior notice for maintenance, inspection, or to mitigate any risk of damage to the Premises or other Members. Any illegal storage or activity discovered will result in immediate termination of membership, forfeiture of privileges, and potential legal action. Members agree to indemnify and hold harmless Falcon Holding II o/b/o Belvedere Cigar Lounge from any liabilities, damages, claims, or legal fees arising from such violations.
3. Assumption of Risk and Limitation of Liability
Members acknowledge and assume all risks associated with cigar smoking and exposure to secondhand smoke. By signing this Agreement, Members and their guests waive any claims against Belvedere, including its affiliates, successors, officers, employees, and agents, for injuries, damages, or losses incurred during the use of the Premises or participation in events.
Belvedere’s total liability, if any, shall not exceed the total annual membership fees paid by the Member.
Under no circumstances will Belvedere be liable for indirect, consequential, punitive, or incidental damages, even if advised of such potential damages.
4. Member Conduct and Responsibilities
Members shall not engage in illegal, disruptive, or unsafe activities on the Premises.
Members are responsible for the conduct and safety of their guests and agree to indemnify Belvedere against claims arising from their guests’ actions.
5. Entire Agreement and Amendments
This Agreement, together with the Membership Application, constitutes the entire understanding between the parties. Amendments or modifications may only be made in writing and signed by both parties.
6. Severability
If any provision of this Agreement is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
7. Acknowledgment of Risks
Members acknowledge that the health risks of cigar smoking are well-documented, and participation in activities involving cigar smoking is entirely voluntary. Members expressly waive and release Belvedere from any liability associated with such risks.
